Terms and Conditions

These Terms and Conditions ("Terms") govern the use of the SoWasIt service provided by Askelia SASU ("we", "our", "us").

1. Acceptance of Terms

By accessing the SoWasIt service, you agree to be bound by these Terms. If you do not accept these terms, do not use our service.

2. Service Description

SoWasIt is a blockchain timestamping service that allows users to create timestamped and verifiable data blocks. The service guarantees the immutability and traceability of submitted data.

SoWasIt offers different hosting modalities:

  • SoWasIt Hosting: Data stored on our secure infrastructure
  • Client Hosting: Data stored on client's infrastructure (Enterprise)
  • Hybrid Solutions: According to specific needs

2.1 Essential Features

  • Immutability: Once created, a block cannot be modified or deleted
  • Permanence: Data is stored permanently
  • Verifiability: Any block can be verified publicly via its hash
  • Timestamping: Each block is timestamped in a cryptographically provable manner

3. User Accounts

3.1 Account Creation

To use certain features, you must create an account by providing:

  • A valid email address
  • Billing information (for paid plans)
  • Accurate and up-to-date information

3.2 Account Responsibility

You are responsible for:

  • The confidentiality of your login credentials
  • All activities under your account
  • Notifying us immediately of any unauthorized use

4. Acceptable Use

4.1 Authorized Uses

You may use SoWasIt for:

  • Timestamping legitimate documents and data
  • Creating proofs of anteriority
  • Ensuring business process traceability
  • Any use compliant with the law

4.2 Prohibited Uses

It is strictly forbidden to use SoWasIt for:

  • Storing illegal, defamatory, or rights-infringing content
  • Sharing confidential information without authorization
  • Distributing pornographic, violent, or discriminatory content
  • Violating third-party intellectual property
  • Propagating malware or spam
  • Conducting fraudulent or deceptive activities
  • Violating laws in force in France or your jurisdiction

5. Content and Data

5.1 Content Ownership

You retain all rights to the content you submit. However, by using our service, you grant us a worldwide, non-exclusive license to:

  • Store and process your content
  • Provide verification services
  • Ensure technical system maintenance

5.2 IMMUTABLE AND DISTRIBUTABLE NATURE OF DATA

⚠️ CRITICAL ATTENTION:

By using SoWasIt, you acknowledge and explicitly accept that:

  • Submitted data is FINAL and IMMUTABLE
  • No modification, deletion, or "right to be forgotten" is technically possible
  • This immutability may conflict with certain GDPR rights
  • You explicitly waive the right to erasure of blockchain data

5.3 EXPORTABILITY AND DATA DUPLICATION

🔄 DISTRIBUTION AND BACKUP:

You acknowledge and accept that:

  • Your blocks and chains are exportable in standard formats (JSON, etc.)
  • Data can be duplicated on external systems for backup and reinforced inalterability
  • For public chains: you explicitly accept that your data may be replicated by third parties on other infrastructures
  • For private chains: you are responsible for controlling access and redistribution by your authorized users
  • SoWasIt cannot guarantee masking of data already exported or replicated outside our infrastructure

5.4 Content Responsibility

You are ENTIRELY RESPONSIBLE for:

  • The legality of submitted content
  • Respecting intellectual property rights
  • Obtaining necessary authorizations
  • The consequences of permanent publication of your data

5.5 Mandatory Prior Verification

Before submitting content, you MUST verify that:

  • The content is legal in your jurisdiction AND in France
  • You have the right to publish it permanently
  • It contains no personal data of third parties without consent
  • It does not violate any confidentiality agreement

6. Moderation and Reporting

6.1 Content Reporting

If you identify potentially illegal content:

Connected Users:

  • Use the "Report" button on the verification page
  • Content will be automatically hidden during our review
  • Processing time: generally within 72 hours (indicative)

Emergency Reporting:

  • Email: report@sowasit.io
  • For situations requiring immediate masking
  • Create an account for optimal follow-up

6.2 Moderation Process

When content is reported:

  1. Automatic masking - Content becomes publicly invisible
  2. Hash preservation - Chain integrity is maintained
  3. Review as soon as possible - We strive to process reports within 72h (indicative, non-contractual)
  4. Final decision:
    • Legal content → Restoration
    • Illegal content → Permanent masking

6.3 Masking Limitations

⚠️ IMPORTANT LIMITATION:

Masking only applies to data hosted on SoWasIt infrastructure. We cannot guarantee:

  • Masking of data already exported by users
  • Masking of data replicated on third-party systems
  • Removal of data backed up by third parties
  • Control of unauthorized redistributions

By publishing content, you accept this limitation intrinsic to the distributable nature of blockchain data.

6.4 Private Chains

For private (non-public) chains:

  • Reporting is transmitted to the chain owner
  • Copy to SoWasIt only if legal emergency
  • Chain owner is responsible for moderation
  • You are responsible for controlling that your authorized users do not redistribute content inappropriately

6.5 Masked Content Display

Blocks with masked content display:

  • Original hash (cryptographic verifiability maintained)
  • Message: "Content masked - Terms of Use violation"
  • Original timestamp

7. Plans and Payments

7.1 Plans and Pricing

Subscription plan details and pricing are available on our Pricing page and may be modified according to our notice conditions.

7.2 Billing and VAT

Subscriptions are billed monthly via Stripe according to the following terms:

  • French individuals: Price including VAT
  • French businesses: Price excluding VAT + applicable VAT
  • Foreign clients: Price excluding VAT (VAT according to local regulations)

French VAT (20%) applies only to clients residing in France.

7.3 Cancellation

You can cancel your subscription at any time. Created blocks remain accessible even after cancellation.

8. Intellectual Property

8.1 SoWasIt Ownership

SoWasIt, its logo, design, documentation, and technology are the exclusive property of Askelia SASU.

8.2 Usage License

We grant you a limited, non-exclusive, non-transferable license to use SoWasIt in accordance with these Terms.

9. Feedback and Suggestions

Any feedback, suggestion, or improvement idea you communicate to us:

  • Becomes our exclusive property
  • May be implemented without compensation or credit
  • Releases us from any confidentiality obligation

10. Promotions and Contests

We reserve the right to organize promotions, contests, or marketing events. Specific conditions will be communicated separately.

11. Service Availability

11.1 Availability Objective

We aim for 99.9% availability but do not guarantee uninterrupted service. Scheduled maintenance may occur.

11.2 Technical Limitations

  • API throughput limited according to your plan
  • Submitted data size limited for performance and service stability reasons
  • Processing time: generally < 100ms
  • Limitations adjustable according to technical service evolution

12. Liability Limitation

12.1 Service "As Is"

SoWasIt is provided "as is" without express or implied warranty. We do not guarantee that the service will meet your specific needs.

12.2 Damage Limitation

Our liability is limited to amounts paid by you over the last 12 months. We cannot be held responsible for:

  • Indirect or consequential damages
  • Data loss
  • Loss of operation or profits
  • Problems caused by third parties
  • Consequences of blockchain data immutability

13. Termination

13.1 Termination by You

You can close your account at any time via settings or by contacting us.

13.2 Termination by Us

We may suspend or close your account in case of:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Non-payment after formal notice
  • Service abuse

13.3 Termination Consequences

After termination:

  • Your dashboard access is removed
  • Public blocks remain verifiable
  • Private chains become inaccessible
  • No refund for the current period

14. Data Protection

The processing of your personal data is governed by our Privacy Policy, which is an integral part of these Terms.

15. Applicable Law and Jurisdiction

15.1 French Law

These Terms are governed by French law. For interpretation or illegal content issues, we apply French and European standards.

15.2 Jurisdiction

Any dispute will be submitted to the competent courts of La Roche-sur-Yon, France.

15.3 Amicable Resolution

Before any judicial recourse, we encourage amicable resolution via mediation.

16. Miscellaneous Provisions

16.1 Modifications

We may modify these Terms by notifying you 30 days in advance. Continued use constitutes acceptance.

16.2 Severability

If a provision is declared invalid, the others remain in force.

16.3 Entirety

These Terms constitute the complete agreement between you and us concerning SoWasIt.
